Step 5: Your building contract

Once you’ve accepted your final quote, we prepare your building contract. This is the agreement that covers the construction of your home.

01

What your contract includes

[CLIENT TO CONFIRM: contract type used, e.g. HIA or MBA standard contract.]

  • The contract price and payment stages
  • The plans and specifications your home will be built to
  • Estimated start and completion timeframes
  • How variations are handled
  • Warranties and responsibilities
02

Your rights under SA law

South Australia has clear rules to protect people building homes. According to the Legal Services Commission of SA:

  • Domestic building work contracts over $20,000 must be in writing and set out all the terms.
  • You have a cooling-off period of five clear business days after signing.
  • Your builder must give you a prescribed notice called "Form 1: Your building contract: your rights and obligations".
  • Statutory warranties apply, including that the work is done in a proper manner, with good quality materials and in line with the law.
03

Building indemnity insurance

Before work starts, we arrange building indemnity insurance for eligible work. In SA, it’s required for building work of $20,000 or more that needs council approval. You’ll receive a copy of the certificate.
